Could I be arrested for not paying the service charge?

Here in my part of Florida by the beach they do not add the service charge which is a cheap way of saying "Tip", when I went to NYC they added it in. I was very furious that they thought they had to decide what type of tip they recieve so i gave them my own tip of 2 dollars. Could I have been arrested for not paying this service charge it's not really a tip if you get to decide how much it is.





I refuse to pay a service charge and give them my own tip.|||If your tip is equal to or more than the service charge, you are paying it.





If you are charged something and don't pay it, it's called defrauding an inn keeper and it is a crime. Most places that include the tip say so on the menu or signs on the door. If you don't want to pay it, don't eat out there.





They probably got tired of people giving crappy tips. Unless your meal was under about $13, you were cheap.|||If the establishment adds the gratuity into the check, then yes. Basically, you failed to pay the entire check.|||Depends. If the menu indicated the price and also that the service charge would be added, and you ordered from that menu, then you agreed to pay and can be charged with defrauding an innkeeper.
